Marriage PR date on file (sic ) The Will of Ezekius Cushing of Hardingham - pub. 22 Jan. 1736 - porv.10 July 1740 In the name of God Amen, I Ezekious Cushing of Hardingham in theCounty of Norfolk, Yeoman, being of sound and disposing mind, memory and understanding thanks beto Almighty God, revoking all former wills heretofore by me made - do make this my lastWill and Testament in manner following (that is to say) I do in the first place give andbequeath my soul into the Hands of Almghty God that gave it trusting in and through the .......... and......... of Jesus Christ my only Saviour and Redeemer to Inherit Everlasting Life and my body I committo the Earth to be decently buried at the Discretion of my Executrix herein after namedand as to such worldly Estate whether Real or Personal it is please God, to bless me with I give anddispose thereof as follows Page 7 of 23 05 September 2009 16:40:54 decently buried at the Discretion of my Executrix herein after namedand as to such worldly Estate whether Real or Personal it is please God, to bless me with I give anddispose thereof as follows (that is to say). Item - I give and Devise unto Diana Bunn, widow my daughter and herheirs all those two pieces of land lying in Hardingham aforesaid one piece where of lyein thehalf acres and the other piece is called or known by the name of Shareys Piglithe ? and also onepiece of land lying in Kimberley field in the said County which said three pieces of land I latelypurchased together with other lands of Henry Cushing, Bricklayer deceased and now in the use andoccupation of Thomas Cushing - upon condition nevertheless that she the said Diana my daughter or herheirs do and shall pay or cause to be paid unto Martha Cushing my daughter the sum of thirtypounds of lawful money of Great Britain within one month next after my decease and if defaultshall happen to be made in payment of the said sum of thirty pounds within the time aforesaidthen I give and devise the ................pieces of land above mentioned unto the said MarthaCushing my daughter and her heirs. Item - I give and devise unto the said Martha Cushing my daughter andher heirs and assignes all my messuages, land, tenements and herediments situate lying and beingin Hardingham aforesaid now in the use and occupation of aforesaid Thomas Cushing his assignesor assigners, Tenants and or Tenants except the aforesaid three pieces of land which Ipurchased of the said Henry Cushing. Charged and chargeable never of four pounds of good and lawful of this Nation unto MARY PYLE mydaughter and her assigns ofr and during the term of her natural life clear of all taxes and............... whichsoever ....... to be paid in or at the now dwelling house of the said Thomas Cushing by twoeven and equall payments in every year. The first of the said payments to be madewithin six calander months next after my Decease and my will and mind is that if default shallhappen to be made of or in payment of the said annuity or yearly rent charge of of any partthereof that then once so often if shall and may be lawful to and for the said Mary Pyle my daughter orher assigns unto all and singular the said pr ment of so charged with the payment of the sameas aforesaid or any part of therein to Enter and to hold and enjoy the same until she or theyshall be fully satisfied and paid not only the said annuity and all arrears thereof if any shallbe, but also all cash and...............which..........or they shall ormay....................or contract unto for on by reason a manner aforesaid non payment and entry. Item - I give and Devise unto the said Martha Cushing my daughter andher heirs and assigns for ever all and singular other my messuages, Lands, Tenements andhereditments whatsoever situate and being in Hardingham and Kimberly aforesaid (not hereinbefore disposed of) to hold the same to the Said Martha Cushing her heirs and assigns charged withthe several ......................hereinafter mentioned. Item - I give and bequeath unto the said Diana Bunn and MARY PYLE mydaughters the sum of twenty shillings aforesaid of lawful money of Great Britain to be paidwithin half a year next after my decease. Item - I give and bequeath unto Elizabeth Bunn my Grandaughter the sumof five pounds of the lawful money to be paid wihin half a year next after my desease and mywill and mind is that in case my personal estate shall fall short of paying my legacies andsuch debts as I shall owe at the time of my desease that then the said last mentioned messuages, lands,hereditments and Tenements and .......... before given to the said Martha Cushing her heirs and assigns for evershall stand charged with the payment of I do hereby make constitute and appoint the said Martha Cushing mydaughter sole Executrix of this my last Will and Testament and to whom I give and bequeath allthe rest and residue of my goods, chattells and personal Estate of whatsoever nature or kind thesame be.
