In the Name of God Amen the twelth day of April in the two andthirtyeth years of
King Charles his raigne the Second and in the yeare of Our Lord GodOne
thousand six hundred and eighty I Thomas Cushen of Hardingham in theCounty
of Norfolk yeoman son of Ezekial Cushen deceased not being sound ofbody but
perfect in memory observing the frailty of mans life and the dailymortality of my
neighbours and such as are taken away suddenly without disposing theire state
for as such as troubled often arise to prevent the same I do make andordain this
to be my last will and testament revoking all former wills by me made
heretobefore. First I committ my soule into the hands of God Almighty maker and
perfecter of my and all mankind hoping through the merits of my Saviour Jesus
Christ to have free pardon of all my sinnes and a lasting place in His heavenly
Kingdom and that my fitknesse to date shall be my entry to lifeeternal. My body I
comitt to the earth to receive christian buriall at the discretion of my Executrix
hereafter named And I dispose of my worldly estate as followeth.
Item - I give unto Mary my loving wife all my lands, houses, tenements, meadows,
pastures (seedings?) and hereditaments whatsoever situate lying and being in
Hardingham aforesaid and Hackford in the County of Norfolk for the terme of ner
natural life she committing................but keeping them inreasonable repair. And
upon condition that she shall pay yearly and every yeare during herlife at the
parish church porch of Hardingham aforesaid twenty shillings a year unto Edward
Durson of Hackford by equall at our Lady and Michals. The firstpayment to begin
at the feast day which first happen next after my decease. And upon condition
that she shall pay yearly and every year during her life unto Ezekial Hubbart of
Hingham tenne shillings a yeare The first payment to begin at the feast day of St.
Michael next after my decease. And upon condition that she shall pay yearly and
every yeare during her life at the parish church porch of Hardingham aforesaid
unto the overseers which soe happen to be overseers for the poore ofthe towne
at Hardingham tenn shillings a yeare and for yearly for ever tenne shillings a
yeare for the benefit of the poore of the said town always upon the Nativity of
Christ called Christmas Day to be laid out and distributed as theoverseers of the
said towne see most needful among the poore there within one weekenext after
they receive the same or else the said payment yearly to ......... and be void. And
for payment of the legacyes aforesaid I (tye?) all my lands andtenements in
Hardingham and Hackford aforesaid. And from and after the decease of the said
Mary my wife I give all the aforesaid premisses unto the child or children which
shee shall be with at the time of my death. But for want of such issue to be living
at the time of her death I give all the aforesaid premisses in Hardingafore said to
Ezekial Cushen son of my brother Ezekial Cushen and to his heyres forever
immediately after my wifes decease. And forwant of such issue asaforesaid to be
living at the time of her death I give all the premisses aforesaidsituate lying and
being in Hackford aforesaid to Thomas Cushing Cushen son of my saidbrother
Ezekial Cushen and to his heires for ever immediately after my wifesdecease the
said Ezekial Cushen paying yearly and every yeare out of the proffittsof the lands
and tenements in Hardingham aforesaid the legavyes and guifs hereafter
mentioned by him to be paid that is to say tenn shillings of lawfulEnglish money
every yeare after my wifes decease to Ezekial Hubbart during the wholeterme of
the naturall life of the said Ezekial Hubbart alwayes upon the feastday of St.
Michael the Crchangel at the parish church porch of Hardinghamaforesaid. And
tenn shillings a yeare yearly and every year for ever unto theoverseers of the
towne of Hardingham for the benefitt of the poore widdows and such asbe most
in want to bee distributed according to the discretion of the saidoverseers he
paying the same every Christmas Day at the parish church porch ofHardingham
and the said overseers within one weeke next after the receipt thereofto
distribute the same or else the payment yearly shall cease and bevoid. And the
said Thomas Cushen likewise paying yearly and every yeare out of theproffitts of
the lands and tenements in Hackford aforesaid twenty shillings a yeareand for
yearly unto Edward Durson of Hackford during the terme of the naturalllife of the
said Edward Durson by equall portions at our Lady and Michal at theparish
church porch of Hardingham aforesaid but if default shall be made inpayment of
the legacyes given to Ezekial Hubbart and to the poore of Hardinghamaforesaid
or in either of them then it shall be lawful for the said EzekialHubbart of the
overseers of Hardingham aforesaid or any of them to enter into all mylands and
tenements in Hardingham before given to Ezekial Cushen my brotherssonn and
to hould and occupy the same until he or they be satisfied their justdue and for
their trouble and the charges they shall be at therein And also ifdefault shall be
made in the payment of the said twenty shillings a yeare to EdwardDurson of
Hackford or in any part thereof then it shll and may be lawfull forthe said
Edweard Durson to enter into all my lands and tenements in Hackfordaforesaid
before given to Thomas Cushen my brothers sonne and to hould andoccupy the
same until he be satisfied his full due and for his trouble and whatcharges he
shall be at thereon. ITEM my will and meaning is that Mary my saidwife shall pay
out of my stocke and goods which I shall leave her the severalllegacyes
hereafter mentioned to the severall persons hereafter named within oneyeare
and a halfe next after my decease at the parish church porch ofHardingham

meaning is that if my wife shall have issue by me living at the timeof her death
that such issue shall pay out of my lands and tenements in Hardinghamand

Thomas Cushing (Ezechias /Cushyne/, Thomas /Cushing/, Nicholas /Cushing/, Thomas /Cushyn/) was born Bef 27 May 1620 in Hardingham, Norfolk, England, and died 1684 in Hardingham, Norfolk, England. He married Mrs Frances Cushing on Abt 1637 in England. She was born 1624 in Hardingham, Norfolk, England. He married Mary Linstead on 27 Jun 1671 in Earlham, Norfolk, England. She was born Abt 1627 in Hardingham, Norfolk, England.
Note: Thomas of Hardingham 1691 Gave to wife Mary to brother-in-law William Reade/Rode " to sons Anthony, Joseph and Thomas " ? to grandchildren- Thomas, Elizabeth and Anthony - Richard and Sarah Loosingham/Lockingham? - Frances, Faith and Joseph My mum has rechecked the wording of Thomas's will 1691- father of Anthony, Joseph, Thomas and female. This is because after she briefly saw son Thomas's will I realised by the daughters married names {Cushing and Marsh} that at least one of his daughter must of been born pre 1691. We think we know why the other grandchildren were mentioned but not Thomas's. On the 1691 will he firstly gives Mary his wife their house {which he bought from William Read brother or brother in law} for the rest of her life, in addition he returned all goods and chattels that she brought with her to the marriage {which she would be free to dispose of in any manner in her will}. He gives £15 to sons Joseph and Anthony and a few shillings to their children plus the unknown daughters children. Son Thomas is to receive everything else which suggests he was probably the eldest son {so he could of been born c1640-45ish as Joseph was born c1645-50} and that his children didn't need to be provided for additionally as Thomas was receiving enough.
Looking at the Hardingham register it is clear that the Hardingham registers were not being kept properly between 1641 and 1663. The handwriting of the entries that have been added for this period matches the handwriting that has entered entries between 1701 and 1713. Therefore, it seems that at some point in time, someone has gone back and filled in the gaps, probably from scraps of paper.

This pattern is repeated in the baptisms, marriages and burials for this period. This is a considerable period and so it is very difficult to be clear about what exactly was going on with the Cushing family in this time as it looks as though quite a number of entries have been missed.”
